The Law

The police work to a system incorporating the “Conflict Resolution Model”, this deals with threat assessment and using the right amount of force to defend ones self.

If you are absolutely sure that a person is going to attack you, you can use the “Pre Emptive Strike” without breaking the law. In a court you would be asked what you did to avoid the conflict and if you had not tried other options prior to the pre– emptive strike there may be doubt as to the credibility of the use of a pre emptive strike.

Instructors of martial arts should have a first aid kit which is fully equipped with the recommended products. The local authority is the body who will tell you what the requirements are for your first aid kit, and authorities will vary. If you have an accident the instructor teaching the class is responsible for the first aid kit, if there is an accident he is liable if he fails to produce a first aid kit or if the first aid kit is not stocked with the goods etc. If you are teaching in a sports centre or church hall it is Always the Instructor who would be responsible for the first aid kit and accident book. Failure to have either of these could be deemed negligent and lead to prosecution.

All instructors must have a mandatory First Aid Certificate—”Appointed Instructor”, a Health and Safety Certificate, Child Protection Certificate, Coaching/Instructing Certificate and Insurance. If you teach children under 11 years of age you may also be required to have a police “Due Diligence Check” to reveal you have no offences of a sexual or violent nature. (Not all of these things are in operation until 2005)

Weapons are all illegal, even a hair comb would be illegal if it were sharp or thought to be used for intentionally harming another person. If you are in the street the only purpose of carrying any weapon is to and from training. On carrying any weapon to or from training you should also carry your martial arts licence and if possible a leaflet showing training times.
